These Terms govern access to and use of the In Your Hand platform. Please read carefully.

SECTION 1 — ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between In Your Hand, Inc. (“In Your Hand”) and any individual or organization (“User”) who accesses, registers, donates, opens a project, or interacts with the platform.

By creating an account, using the platform, submitting documents, receiving funds, uploading content, or clicking “I Agree,” the User:

  • Accepts all provisions of these Terms,
  • Consents to electronic signatures and notifications,
  • Agrees to comply with all platform rules,
  • Acknowledges that In Your Hand reserves the right to amend these Terms at any time.

Use of the platform is prohibited if the User does not accept these Terms.

SECTION 2 — DEFINITIONS

  • “Platform”: All digital systems owned or operated by In Your Hand.
  • “User”: Any person or entity creating an account.
  • “Project Owner”: Individual or institutional User opening a fundraising project.
  • “Donor”: Any User contributing funds.
  • “Beneficiary”: Individual or community receiving assistance.
  • “Restricted Donation”: Funds held and managed by In Your Hand exclusively for a specific project.
  • “Disbursement”: Transfer of funds approved by In Your Hand to project owners or vendors.
  • “Compliance Requirements”: OFAC, AML/CFT, KYC/KYB, documentation, reporting, and ethical obligations.

SECTION 3 — ROLE OF IN YOUR HAND (PLATFORM MODEL)

In Your Hand operates as a fiscal sponsor & intermediary. This means:

  1. All donations are legally received and owned by In Your Hand until disbursed.
  2. Users do not gain ownership of funds until In Your Hand authorizes disbursement.
  3. In Your Hand must follow U.S. nonprofit laws including:
    • IRS Expenditure Responsibility
    • Anti-Terror Financing laws (OFAC)
    • AML/CFT requirements
  4. In Your Hand may reject, pause, or terminate any project or transaction for risk, compliance, or legal reasons.

The platform is NOT a bank, investment service, money transfer business, or crowdfunding marketplace.

SECTION 4 — USER CATEGORIES AND SPECIAL TERMS

4.1 General Users

Users must:

  • Be at least 18 years old,
  • Provide accurate account information,
  • Maintain security of their login credentials,
  • Not engage in fraudulent, illegal, hateful, or harmful actions.

4.2 Individual Project Owners

Individuals opening projects must:

  • Complete identity verification (KYC),
  • Submit a Project Intent Letter,
  • Provide all required documents (budget, plan, photos, receipts),
  • Accept personal liability for post-disbursement refund obligations,
  • Use funds exclusively for the approved purpose,
  • Cooperate fully with audits and verification.

4.3 Institutional Partners

Organizations must:

  • Complete KYB verification,
  • Submit:
    • Registration certificate
    • Tax ID or equivalent
    • Authorized signatory list
    • Board resolution approving partnership
  • Agree to reporting, monitoring, and field verification rules,
  • Not represent themselves as agents of In Your Hand.

4.4 Donors

Donors have the right to:

  • Receive receipts,
  • Request refunds under qualifying conditions,
  • View project reports and media,
  • Expect transparency.

Donors acknowledge:

  • Donations are restricted charitable gifts,
  • In Your Hand has discretion to reallocate funds if a project becomes impossible, unsafe, or fraudulent.

4.5 Volunteers / Field Operators

They must follow:

  • Safeguarding rules,
  • Ethical media standards,
  • Safety and operational guidelines.

SECTION 5 — PLATFORM ACCESS & VERIFICATION

5.1 Identity Verification (KYC)

In Your Hand requires:

  • Legal name
  • Government ID
  • Live selfie or biometric match
  • Proof of address
  • Sanctions screening

Accounts may be suspended for failure or refusal.

5.2 Institutional Verification (KYB)

Required documents include:

  • Legal registration papers
  • Organizational ID number
  • Authorized signatory documentation
  • Director/Board resolution
  • Beneficial ownership declaration

SECTION 6 — PROJECT CREATION & APPROVAL

Users may create projects only after completing verification.

Required items:

  • Project summary
  • Objectives and beneficiary description
  • Budget and procurement plan
  • Timeline
  • Intent Letter (signed)
  • Photos or preliminary documentation

In Your Hand may:

  • Approve or reject a project,
  • Request additional information,
  • Conduct field or remote checks.

SECTION 7 — DONATION HANDLING & FUND CONTROL

7.1 Ownership of Donations

All funds donated through the platform become:

➡️ Restricted charitable funds held by In Your Hand.
Project owners cannot claim ownership until disbursed.

7.2 Use of Funds

Funds may only be used for:

  • Approved project activities
  • Documented procurement
  • Direct beneficiary support

Misuse of funds results in:

  • Repayment obligation
  • Account closure
  • Legal action if needed
  • Permanent ban from the platform

7.3 Disbursement Conditions

In Your Hand will disburse funds only after:

  • Compliance review
  • Sanctions screening
  • Document verification
  • Risk assessment
  • Procurement validation

Disbursement may be:

  • Full
  • Partial
  • Vendor-direct payment
  • Withheld entirely

SECTION 8 — EXPENSE REPORTING & AUDIT REQUIREMENTS

Project owners must submit:

  • Receipts and invoices
  • Proof of payment (bank slip, transfer confirmation)
  • Photos/videos of activities
  • Delivery reports
  • Beneficiary lists (when appropriate)
Retention requirement:
7 years.

In Your Hand may conduct audits at any stage. Failure to provide documentation may result in fund recovery, project closure, or account termination.

SECTION 9 — MEDIA, STORYTELLING & CONTENT RULES

Users must:

  • Follow ethical storytelling rules,
  • Obtain consent for images (especially children),
  • Avoid humiliating, exploitative, or staged content.

In Your Hand receives:

A non-exclusive, royalty-free license to use uploaded media for transparency, reporting, and non-commercial promotion.

Prohibited:

  • Graphic images
  • False or manipulated media
  • Sensitive personal data
  • Political messages

SECTION 10 — PROHIBITED ACTIVITIES

Users are prohibited from:

  • Fundraising for political campaigns or extremist causes
  • Money laundering
  • Terror financing
  • Misuse of funds
  • Fraudulent documentation
  • Harassment or hate speech
  • Circumventing the platform
  • Contacting donors privately for fundraising
  • Creating duplicate or fake accounts

SECTION 11 — REFUNDS & CHARGEBACKS

11.1 Before Disbursement

If funds have not yet been disbursed, donor refunds may be issued immediately.

11.2 After Disbursement

If funds have already been transferred, refunds may still be required in cases of:

  • Fraud
  • Misuse
  • Error
  • Legal obligation
  • Project failure
➡️ In such cases, the Project Owner assumes full financial liability to reimburse In Your Hand.

SECTION 12 — INVESTIGATIONS, FREEZES & TERMINATION

In Your Hand may:

  • Freeze funds
  • Suspend accounts
  • Terminate projects
  • Withhold disbursement
  • Request additional documents
  • Conduct internal or external audits
  • Notify authorities when required

Grounds include:

  • Fraud
  • Non-cooperation
  • Sanctions match
  • Ethical breach
  • Safety concerns
  • AML/CFT red flags

Termination may be immediate and without notice.

SECTION 13 — LIABILITY LIMITATION

In Your Hand is not liable for:

  • User misconduct
  • Actions of field partners
  • Bank or payment provider errors
  • Harm caused by third parties
  • Losses due to cyberattacks affecting the user
  • Political, logistical, regional instability
  • Delays caused by suppliers
Maximum liability is limited to the amount of the User’s most recent fee payment or donation (if any).

SECTION 14 — GOVERNING LAW & DISPUTE RESOLUTION

    2. Internal resolution
    3. Mediation
    4. Binding arbitration
  • User waives class-action rights.

SECTION 15 — MODIFICATION OF TERMS

In Your Hand may update these Terms at any time.

Continued use constitutes acceptance.

SECTION 16 — DIGITAL SIGNATURE & CONSENT

By clicking “I Agree,” User acknowledges:

  • These Terms are enforceable under the U.S. E-SIGN Act
  • Digital acceptance creates a binding legal contract
  • All electronically stored records may be used as evidence

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect.
