Refund & Financial Responsibility Agreement (A16)
This Agreement applies to individual project owners / fundraisers and outlines refund responsibility, documentation obligations, and financial accountability.

1. Purpose of This Agreement
This Agreement is between In Your Hand, Inc. (“IYH”) and the Individual Project Owner (“Project Owner”).
It outlines the Project Owner’s financial obligations related to donation refunds, misallocated or misused funds, compliance failures, documentation requirements, and fund tracking/accountability.
By opening a project, the Project Owner accepts full financial responsibility for the funds received.
2. Refund Policy Overview
2.1 Pre-Disbursement
- Donors may request full or partial refunds.
- IYH may issue refunds without Project Owner approval.
- No financial burden is placed on the Project Owner at this stage.
2.2 Post-Disbursement
After funds are disbursed to the Project Owner, refunds may still be required in exceptional situations (including fraud, error, donor complaint, or compliance failure).
- The Project Owner becomes financially responsible for repaying refunded amounts.
- IYH may deduct future disbursements to recover refunded funds.
- If insufficient funds exist, the Project Owner must repay the balance personally.
3. Conditions That May Trigger Refunds
Refunds may be issued if:
- Donor accidentally donates (wrong amount, duplicate donation).
- Donor claims unauthorized use of credit card.
- Project Owner fails to complete the project.
- Inconsistency or red flags are detected.
- Project Owner violates compliance rules.
- Misuse, misallocation, or non-completion of the project is confirmed.
- Project Owner submits false or incomplete documentation.
4. Project Owner’s Financial Responsibilities
The Project Owner agrees to:
- ✓Maintain accurate financial records.
- ✓Use funds exclusively for approved project purposes.
- ✓Provide full evidence of expenditures.
- ✓Return funds upon request if misuse or failure is determined.
- ✓Accept liability for losses caused by negligence or misconduct.
5. Documentation Requirements
The Project Owner must upload:
- Invoices
- Receipts
- Beneficiary distribution lists
- Delivery photos/videos
- Proof of purchase
- Proof of service completion
Failure to provide documentation may result in:
- Withheld disbursements
- Refund obligations
- Suspension of the project
- Account termination
6. Inappropriate Use of Funds
The Project Owner agrees that funds may NOT be used for:
- Personal expenses (rent, bills, transport unrelated to project)
- Debt repayment
- Private gifts
- Unapproved activities
- Commercial ventures
- Religious or political campaigns
Unauthorized use constitutes fund misuse and triggers refund liability.
7. Fraud, Misuse, and Misrepresentation
If the Project Owner:
- Submits false information
- Falsifies invoices or reports
- Misleads donors
- Misallocates or diverts funds
- Stages photos or manipulates evidence
Then:
- All project funds may be recalled
- Full refund obligations will apply
- The account may be terminated
- Authorities may be notified
8. Chargebacks & Disputes
If donors initiate a chargeback, the Project Owner acknowledges:
- IYH may be required to refund the bank/processor.
- The Project Owner must reimburse IYH if funds were already disbursed.
- Excessive chargebacks may trigger project closure.
9. In Your Hand’s Rights
IYH reserves the right to:
- Freeze funds
- Delay or stop disbursements
- Recover refunded or misused funds
- Suspend accounts
- Conduct financial audits
- Request additional documentation
- Notify law enforcement in cases of fraud
10. Limitation of Liability
The Project Owner acknowledges that:
- IYH is NOT liable for the Project Owner’s misconduct.
- IYH is NOT financially responsible for poor execution of the project.
- IYH is NOT responsible for external events (vendor failure, supply delays, field issues).
- The Project Owner assumes full responsibility for their project and actions.
11. Personal Liability Declaration
The Project Owner understands and agrees:
- ✓They are personally financially liable for funds misused.
- ✓They are responsible for reimbursing refunded amounts after disbursement.
- ✓They may face civil or criminal action if fraud is committed.
12. Term of Agreement
This Agreement remains in effect:
- For the duration of the project
- Until all funds are accounted for
- Until all refunds and obligations are resolved
13. Declaration of Truthfulness
The Project Owner certifies that:
- ✓All statements made are truthful.
- ✓They fully understand financial responsibilities.
- ✓They accept all refund-related obligations.
- ✓They will comply with monitoring and verification requirements.
